Bir taraftan Kýbrýs Cumhuriyeti, diðer taraftan Yunanistan, Ýngiltere ve Türkiye,

1. Anayasanýn esas maddeleri ile kurulan ve düzenlenen Kýbrýs Cumhuriyetinin baðýmsýzlýðýnýn, toprak bütünlüðünün ve güvenliðinin tanýnmasý ve devamýnýn kendi ortak yararlarý gereði olduðunu dikkate alarak.

2. Sözü edilen anayasa ve oluþturulan duruma saygý gösterilmesini güvence altýna alacak iþbirliðini arzulayarak, aþaðýdaki hususlar üzerinde anlaþmaya varmýþlardýr. Buna göre :

MADDE 1.

Kýbrýs Cumhuriyeti, kendi baðýmsýzlýðýný, toprak bütünlüðünü ve güvenliðini devam ettirmeyi ve anayasaya saygýyý güven altýna almayý üstlenir. (taahhüt eder)

Kýbrýs Cumhuriyeti, ayrýca tümüyle veya bir bölümüyle herhangi bir devlet ile hiçbir þekilde siyasi veya ekonomik bütünleþmeye girmeyeceðini taahhüt eder. (sorumluluðunu yüklenir)

Kýbrýs Cumhuriyeti, bu maksatla adanýn gerek birleþmesini, gerekse taksimini doðuracak doðrudan doðruya (direkt olarak) veya dolaylý olarak gerçekleþtirmeye yardýmcý ve teþvik edici tüm hareketleri yasaklar.

MADDE 2.

Yunanistan, Ýngiltere ve Türkiye, Kýbrýs Cumhuriyeti'nin 1'nci maddede belirtilen taahhütlerini kaydederek, Kýbrýs Cumhuriyeti'nin baðýmsýzlýðýný, ülke bütünlüðünü, güvenliðini ve anayasanýn temel maddeleri ile oluþan durumu (state of affairs) tanýrlar ve garanti ederler.

Yunanistan, Ýngiltere ve Türkiye, Kýbrýs Cumhuriyeti'nin diðer herhangi bir devlet ile gerek birleþmesini. gerekse Ada'nýn taksimini doðrudan doðruya, veya dolaylý olarak gerçekleþtirmeye yardým ve teþvik edici bir amacý olan tüm hareketleri kendi yetki ve ilgileri oranýnda önlemeyi üstlenirler.

MADDE 3.

Bu Antlaþma hükümlerinin herhangi birinin ihlali (çiðnenmesi) halinde Yunanistan, Türkiye ve Ýngiltere bu hükümlere saygýyý saðlamak için gerekli giriþimlerin yapýlmasý ve önlemlerin alýnmasý maksadýyla aralarýnda danýþmalarda bulunmayý üstlenirler.

Üç garantör devletten biri, birlikte veya birbirlerine danýþarak (iþbirliði halinde) hareket etmek olanaðý bulunmadýðý taktirde, bu antlaþmanýn oluþturduðu durumu (state of affairs) münhasýran yeniden oluþturmak gayesi ile hareket etmek hakkýný korumaktadýrlar.

MADDE 4.

Bu antlaþma imza edildiði gün yürürlüðe girecektir.

Yüksek Akit Taraflar, Birleþmiþ Milletler Þartýnýn (charter) 102'nci maddesi hükümlerine uygun olarak bu antlaþmayý Birleþmiþ Milletler Genel Sekreterliðine en kýsa sürede kaydettirmeyi üstlenirler.”

Görüldüðü gibi AB, Uluslararasý antlaþmalara aykýrý olarak Kýbrýs Cumhuriyetini bünyesine almýþtýr. Bu katýlým kellemyekün (bütün sonuçlarý ile) atýl, muattal ve yok hükmündedir. Geçersizdir. Bundan çok deðil yaklaþýk 1.5 ay önce Avrupa Komisyonu tarafýndan kendi Avukatlarý tarafýndan hazýrlanan “Güney Kýbrýs Rum Devleti’nin, Kýbrýs Cumhuriyeti adý ile AB’ye katýlým ve kabulü” ile ilgili rapor da ayný hususu teyit ve tasdik eder niteliktedir. Ortada büyük bir hata vardýr. Katýlým hukuken geçersizdir. Buna raðmen AB Þimdi de Kýbrýs’ýn tamamýný istemektedir.

AYRICA:

1. 16 Temmuz 1974’de, ABD ve Ýngiltere Türkiye’den Kýbrýs’a müdahalesi istemiþ ve ayný gün meþru ve yasal (devrik) Cumhurbaþkaný Papaz Makarios tarafýndan, yeni C.Baþkaný Nikos Sampson’un ENOSÝS militaný olduðu açýklanmýþ; 17 Temmuz’da Baþbakan Bülent Ecevit Ýngiltere Baþbakaný Harold Wilson ile görüþmüþ; 18 Temmuz günü Yunanistan 5 uçak dolusu asker, silâh ve mühimmatý Kýbrýs’a indirmiþ; 19 Temmuz 1974’de, toplantý halinde bulunan TC Bakanlar Kurulu’na BM Genel Sekreteri Waldheim ivedi bir mesaj göndererek: “Ada’da (Kýbrýs’ta) tek meþru yönetim Türk Ýdaresidir” demiþ ve nihayet: Bütün bu meþru ve yasal zemine dayanýlarak 20 Temmuz 1974 günü Türkiye “Kýbrýs Harekâtýný” , bütün usul ve esaslarý muvacehesinde ve “uluslar arasý meþruiyet” çerçevesinde yapmýþtýr. (3)

2. Müteakip süreçte Yunanistan Temyiz Mahkemesi 21 Mart 1979 tarihinde 2658/79 sayýyla bir karar vererek: “Türk Ordusunun Kýbrýs’a müdahalesi yasaldýr. Suç, Yunan subaylarýna aittir” demiþtir. (4) Bu karar, o dönemin Baþbakaný Konstantin Karamanlis tarafýndan, “Yunanistan aleyhine kullanýlabilir” gerekçesiyle kamuoyuna duyurulmasý yasaklanmýþ ve dava dosyalarý “Çok gizli” kaydýyla kasaya konulup Türk ve dünya kamuoyundan saklanmýþtýr. Aslýnda çok önemli olan bu olayý biraz daha açmak gerek. Þöyle ki:

OLAYLAR ÞÖYLE GELÝÞÝYOR

”Türk Ordusunun Kýbrýs’a müdahalesi yasaldýr” kararýnýn alýnmasýyla ilgili geliþmeler Þöyle karþýmýza çýkýyor: 1976 yýlýnda bir Yunanlý, mahkemeye baþvurarak, 22 Temmuz 1974 tarihinde Lefkoþa üzerinde uçarken, bir uçak Güney Kýbrýslýlarýn açtýklarý ateþ sonucu düþüp parçalanýyor. Yunan Delta nakliye uçaðýnýn içinde bulunan ve ölen oðlu için tazminat talebinde bulunuyor davacý Yunan vatandaþý. Atina Mahkemesi 1978 yýlýnda bir karar veriyor. Þöyle:

“Davacý davasýnda haklýdýr. Hazineden tazminat almasý gerekmektedir.” Ekonomi Bakanlýðý tazminatý ödememek için, karara karþý çýkýyor ve temyize baþvurarak, kararýn bozulmasýný istiyor. Sonuçta karar bozulmuyor. Yunan Temyiz Mahkemesi kararý bozmadýðý gibi, güçlendirici bir karar veriyor. 21.03.1979 tarih ve 2658/79 sayýlý kararýn tam tercümesi þöyle:

”Davacý tarafýndan öne sürülen iddialarýn gerçek olduðu, mahkememizce yapýlan araþtýrma sonucu kanýtlandý. Zürich Antlaþmasýný imzalayan taraflar, Yunanistan, Türkiye ve Ýngiltere “Garantör” devletler olarak, Kýbrýs’ýn herhangi bir devlet ile birleþmesini ya da bölünmesini önlemek için, “Kýbrýs Cumhuriyeti” nin güvenliðini garanti altýna alýp koruyacaklarýna dair taahhütte bulunmuþlardýr.

1974 Temmuz ayýnýn ilk haftasý içinde Kýbrýs Devlet Baþkaný Makarios, Ada’da görev yapan bazý subaylarýn, darbe giriþimi hazýrladýðý içinde bulunduklarý ve kendisini öldürmeyi planladýklarýný öðrenmiþ ve durumu Atina’ya duyurarak, Yunanistan Devlet Baþkaný General Gizikis’ten önlem alýnmasýný istemiþtir.

Ancak Atina’daki yönetim, bu talebe resmi bir cevap vereceði ya da önlem alacaðý yerde, 15 Temmuz 1974’de General Yoannidis, Makarios’a karþý, Kýbrýs’taki Yunan Birliðinin Komutaný General Yorgitsis ve General Yanakodimos ile birlikte 102 Yunan subayýnýn da yer aldýklarý darbeyi gerçekleþtirdi ve Makarios’u öldürmeye teþebbüs etti.

Lefkoþa’daki Baþkanlýk Sarayý aðýr silahlarla ateþe tutulmuþ, Baþkan Makarios bu saldýrýdan bir mucize olarak kurtulmuþtur. Kýbrýs Anayasasý asi Yunan subaylarý tarafýndan çiðnendikten sonra, Nikos Samson baþa getirildi. Türkiye Ýse 20 Temmuz 1974’de, yaratýlan durum nedeniyle hukuki hakkýný kullanarak Kýbrýs’a müdahalede bulunmuþtur”

Bu kararla; Türkiye’nin 1960 Kýbrýs Cumhuriyeti Anayasasý ve Garanti Anlaþmasýnýn 4 ncü maddesi uyarýnca, Türkiye’nin hukuki haklarýný kullandýðý ortaya çýkýyor. Yunanistan tarafýndan gönderilen bin Generalin yönettiði ve üst düzey subaylarýn neredeyse tamamý Yunanlý olan RMMO’ya esir düþenler, hayatýný kaybedenler, aileleri, yaþamlarý ve düzenleri bozulanlar, iþlerini kaybedenler, yerini-yurdunu terk edip göç etmek zorunda kalanlar ve maðduriyete uðrayan herkes, Yunanistan’a karþý tazminat davasý açabilecektir. Bu yolun açýldýðý, açýk olduðu görülmektedir.

TÜRKÝYE ÝÞGAL ETMEDÝ
Türkiye, Zürich ve Londra Anlaþmalarýyla kurulan “Kýbrýs Cumhuriyeti” ni ne parçalamýþ ne de iþgal etmiþtir. Zaten bu müdahale, iþgal olarak kabul edilmiþ olsaydý, uluslararasý tepki herhalde çok daha farklý boyutlarda geliþirdi.

1974 yýlýndan bugüne kadar geçen zaman içinde, Birleþmiþ Milletler’in ortaya koyduðu çözüm formüllerini, Kýbrýs Türk tarafý hiçbir zaman reddetmedi. Hep tartýþmaya açýk tutmuþ olmasýna raðmen, karþý taraf her defasýnda anlaþma masasýndan kaçmýþ, dünya kamuoyunun karþýsýna deðiþik ve anlaþýlmasý zor koþullarla çýkmýþtýr.

Ne var ki, AB baþta olmak üzere, Batý dünyasýndakilerin büyük bir bölümü, bu gerçeðin ya farkýnda deðildir, ya da politikalarý gereði böyle davranmaktadýrlar.

NETÝCE OLARAK :

1.KKTC ve Türkiye’nin elinde bunlar ve bunlardan baþka daha binlerce bilgi, belge BM kararý ve fiilen yaþanmýþ olay var. 1958 öncesi ve sonrasýna ait bu belge, bilgi ve olaylar ustalýk ve isabetle kullanýlmak;

2. Halihazýr Kuzey Kýbrýs Türk Cumhuriyetine uygulanan abluka ve izolasyon yasa dýþýdýr. Ýnsanlýk ve ahlâk dýþýdýr. Buna dair olmak üzere BM dahil hiçbir meþru kurum tarafýndan alýnmýþ bir yaptýrým kararý ve yasal dayanaðý yoktur. Ýnsanlýk onuru ve uluslar arasý hukuka aykýrý bu zulüm ve iþkence ileri sürülerek;

3. 1959 tarihli ve yukarda esasý derc olunan “Uluslar arasý kabul görmüþ ve BM’de kayýt ve tescilli” Londra, Zürich ve Garanti Antlaþmalarý ileri sürülerek;

4. AB sürecine “Kýbrýs” konusunun bütün bu karineleri, meri anlaþmalar, yaþanan olaylar ve bütün bunlara müsteniden haklý, doðru, hukuki ve meþru bir biçimde ilân edilmiþ “Kuzey Kýbrýs Türk Cumhuriyeti” devletine raðmen; Hiçbir Türk, Yunan, Ýngiliz ve sair örgüt, devlet ve milletlere mensup, atanmýþ veya seçilmiþ temsilci, müzakereci, devlet-hükümet baþkaný veya delegasyonun söz, teklif ve tasarruf hakkýnýn bulunmadýðý ispat olunarak; Kýbrýs konusunda Türkiye,

The banking law and guidelines here stipulates that if such money remained unclaimed after Three years, the money will be transfered into the banktreasury as unclaimed fund. The money has now stayed more than three years and I am preparing documentaion to prove that this money has been
transfered to our bank treasury. It will be between me and you only that will know that the money is not transfered into our treasure.

This request of foreigner as next of kin in this transaction is occasioned by the fact that the customer was a foreigner and a Burkinabé cannot standas next of kin to a foreigner.In appreciation of your assistance, I am offering you 30% of the total sum. 5% for contingencies (cost of transfer/other charges) likely to be incurred during the course of transaction, while the remaining 65% is for me.
